L\u2019article soulignait l\u2019importance pour les parties de demeurer vigilantes \u00e0 l\u2019\u00e9gard des changements r\u00e8glementaires et l\u00e9gislatifs qui ont une incidence sur les processus de raccordement et la responsabilit\u00e9 en mati\u00e8re de co\u00fbts, et de comprendre les r\u00e9percussions des changements apport\u00e9s au march\u00e9 de gros de l\u2019\u00e9lectricit\u00e9 en Ontario par le Programme de renouvellement du march\u00e9 (\u00ab\u00a0PRM\u00a0\u00bb) administr\u00e9 par la Soci\u00e9t\u00e9 ind\u00e9pendante d\u2019exploitation du r\u00e9seau d\u2019\u00e9lectricit\u00e9 (\u00ab\u00a0SIERE\u00a0\u00bb). Depuis la publication de cet article, plusieurs annonces ont \u00e9t\u00e9 faites, et celles-ci auront une incidence sur le raccordement des centres de donn\u00e9es en Ontario. Le pr\u00e9sent addenda souligne les principaux changements politiques et l\u00e9gislatifs auxquels devrait pr\u00eater attention le secteur de l\u2019\u00e9nergie.<\/span><\/p>\n<p class=\"BodyJustifiedMain\" style=\"text-align: justify; letter-spacing: 0.1pt; font-style: normal; font-variant-ligatures: normal; font-variant-caps: normal; font-weight: 400; orphans: 2; text-indent: 0px; text-transform: none; widows: 2; word-spacing: 0px; -webkit-text-stroke-width: 0px; white-space: normal; text-decoration-thickness: initial; text-decoration-style: initial; text-decoration-color: initial;\"><span lang=\"FR-CA\" style=\"letter-spacing: 0pt;\">Le 3\u00a0juin, le gouvernement a pr\u00e9sent\u00e9 la <span class=\"Italic\" style=\"font-style: italic;\">Loi de\u00a02025 pour prot\u00e9ger l\u2019Ontario en garantissant l\u2019acc\u00e8s \u00e0 l\u2019\u00e9nergie abordable pour les g\u00e9n\u00e9rations futures <\/span>(le \u00ab\u00a0projet de loi\u00a040\u00a0\u00bb), qui traite explicitement du raccordement des centres de donn\u00e9es<sup><a title=\"\" href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a><\/sup>. Bien que le r\u00e9seau d\u2019\u00e9lectricit\u00e9 de l\u2019Ontario ob\u00e9isse \u00e0 l\u2019imp\u00e9ratif fondamental de fournir un acc\u00e8s non discriminatoire (c\u2019est-\u00e0-dire que tout participant peut s\u2019y raccorder, peu importe son identit\u00e9 ou ses caract\u00e9ristiques), le projet de loi\u00a040 cr\u00e9e une exception \u00e0 ce droit d\u2019acc\u00e8s pour \u00ab\u00a0des installations de charge\u00a0pr\u00e9cis\u00e9es\u00a0\u00bb qui se raccordent au r\u00e9seau \u00e9lectrique de l\u2019Ontario<sup><a title=\"\" href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a><\/sup>. L\u2019article\u00a028.1 propos\u00e9 de la <span class=\"Italic\" style=\"font-style: italic;\">Loi de 1998 sur l\u2019\u00e9lectricit\u00e9 <\/span>pr\u00e9cise que les transporteurs ou les distributeurs ne doivent pas raccorder (ou raccorder de nouveau) une \u00ab\u00a0installation de charge pr\u00e9cis\u00e9e\u00a0\u00bb au r\u00e9seau \u00e9lectrique \u00e0 moins que les exigences en mati\u00e8re de raccordement \u00e9nonc\u00e9es dans les r\u00e8glements ne soient respect\u00e9es<sup><a title=\"\" href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a><\/sup>. Une \u00ab\u00a0installation de charge pr\u00e9cis\u00e9e\u00a0\u00bb s\u2019entend d\u2019une installation ou d\u2019une cat\u00e9gorie d\u2019installations \u00ab\u00a0qui est un centre de traitement de donn\u00e9es\u00a0\u00bb et qui satisfait aux crit\u00e8res fix\u00e9s par les r\u00e8glements<sup><a title=\"\" href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a><\/sup>. Au moment de sa publication, le projet de loi n\u2019avait franchi que l\u2019\u00e9tape de la premi\u00e8re lecture et aucun r\u00e8glement n\u2019\u00e9non\u00e7ait d\u2019exigences pr\u00e9cises en mati\u00e8re de raccordement. Toutefois, si le projet de loi\u00a040 est adopt\u00e9, les promoteurs de centres de donn\u00e9es qui d\u00e9sirent se raccorder au r\u00e9seau de l\u2019Ontario pourraient bient\u00f4t \u00eatre assujettis \u00e0 des exigences suppl\u00e9mentaires.<\/span><\/p>\n<p class=\"BodyJustifiedMain\" style=\"text-align: justify; letter-spacing: 0.1pt; font-style: normal; font-variant-ligatures: normal; font-variant-caps: normal; font-weight: 400; orphans: 2; text-indent: 0px; text-transform: none; widows: 2; word-spacing: 0px; -webkit-text-stroke-width: 0px; white-space: normal; text-decoration-thickness: initial; text-decoration-style: initial; text-decoration-color: initial;\"><span lang=\"FR-CA\" style=\"letter-spacing: 0pt;\">Le 12\u00a0juin, le gouvernement a publi\u00e9 son premier Plan int\u00e9gr\u00e9 de l\u2019\u00e9nergie, \u00ab\u00a0<span class=\"Italic\" style=\"font-style: italic;\">L\u2019\u00e9nergie pour les g\u00e9n\u00e9rations \u00e0 venir\u00a0: Le plan int\u00e9gr\u00e9 de l\u2019Ontario pour alimenter la plus forte \u00e9conomie du G7\u00a0<\/span>\u00bb (le \u00ab\u00a0Plan\u00a0\u00bb)<sup><a title=\"\" href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a><\/sup>. Le Plan, qui est exig\u00e9 par la nouvelle <span class=\"Italic\" style=\"font-style: italic;\">Loi de\u00a02024 sur l\u2019\u00e9nergie abordable<\/span>, \u00e9nonce plusieurs nouveaux programmes et nouvelles initiatives visant \u00e0 offrir une \u00e9nergie \u00ab\u00a0abordable, s\u00fbre, fiable et propre\u00a0\u00bb<sup><a title=\"\" href=\"#_ftn6\" name=\"_ftnref6\">[6]<\/a><\/sup>. En ce qui concerne les centres de donn\u00e9es, le Plan fait mention de l\u2019augmentation pr\u00e9vue de la demande provenant du secteur des centres de donn\u00e9es et du nouveau projet de loi\u00a040. Plus pr\u00e9cis\u00e9ment, le Plan souligne le projet de loi\u00a040 pr\u00e9sent\u00e9 et la fa\u00e7on dont il \u00ab\u00a0permettra \u00e0 l\u2019Ontario de g\u00e9rer les demandes de raccordement au r\u00e9seau \u00e9lectrique et de donner la priorit\u00e9 aux centres de donn\u00e9es qui apportent de r\u00e9els avantages locaux, strat\u00e9giques et \u00e9conomiques, et pas seulement une hausse de la consommation d\u2019\u00e9lectricit\u00e9\u00a0\u00bb\u00a0<sup><a title=\"\" href=\"#_ftn7\" name=\"_ftnref7\">[7]<\/a><\/sup>. Cet objectif s\u2019harmonise avec la proposition \u00e9nonc\u00e9e dans le projet de loi\u00a040 d\u2019introduire de nouveaux objets dans la <span class=\"Italic\" style=\"font-style: italic;\">Loi sur la Commission de l\u2019\u00e9nergie de l\u2019Ontario <\/span>et la <span class=\"Italic\" style=\"font-style: italic;\">Loi sur l\u2019\u00e9lectricit\u00e9 <\/span>pour soutenir la croissance \u00e9conomique, et pourrait offrir un aper\u00e7u des objectifs strat\u00e9giques que les exigences en mati\u00e8re de raccordement \u00e9ventuellement \u00e9tablies par r\u00e8glement pourraient viser \u00e0 promouvoir. Compte tenu de ces d\u00e9tails et du fait que les exigences applicables ne sont pas encore connues, les promoteurs de centres de donn\u00e9es devraient envisager des fa\u00e7ons de d\u00e9montrer leur potentiel \u00e9conomique dans la r\u00e9gion o\u00f9 ils d\u00e9sirent se raccorder.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"font-style: normal; font-variant-ligatures: normal; font-variant-caps: normal; font-weight: 400; letter-spacing: normal; orphans: 2; text-align: start; text-indent: 0px; text-transform: none; widows: 2; word-spacing: 0px; -webkit-text-stroke-width: 0px; white-space: normal; text-decoration-thickness: initial; text-decoration-style: initial; text-decoration-color: initial;\">Le paysage r\u00e8glementaire du d\u00e9veloppement et du raccordement des centres de donn\u00e9es en Ontario continue d\u2019\u00e9voluer. Avec le d\u00e9p\u00f4t du projet de loi 40, la publication du premier Plan int\u00e9gr\u00e9 de l\u2019\u00e9nergie de l\u2019Ontario et une plus grande exp\u00e9rience du march\u00e9 \u00e0 la suite du Programme de renouvellement du march\u00e9 de la SIERE, les promoteurs de centres de donn\u00e9es doivent demeurer attentifs aux nouvelles exigences et aux changements de la politique publique. M\u00eame si l\u2019\u00e9tendue de ces r\u00e9percussions est encore inconnue \u2014 d\u2019autant plus que les r\u00e8glements d\u2019application pris en vertu du projet de loi 40 n\u2019ont pas encore \u00e9t\u00e9 publi\u00e9s \u2014 l\u2019information disponible pr\u00eate \u00e0 penser qu\u2019il pourrait \u00eatre important pour les promoteurs de centres de donn\u00e9es de d\u00e9montrer la valeur \u00e9conomique d\u2019un acc\u00e8s s\u00e9curis\u00e9 au r\u00e9seau. Les promoteurs devraient continuer de suivre de pr\u00e8s l\u2019\u00e9volution de la situation et consulter la CEO et la SIERE \u00e0 une \u00e9tape pr\u00e9coce pour s\u2019y retrouver plus facilement dans ce nouveau cadre.<\/p>\n<ul class=\"footnote\" style=\"list-style-type: none;\">\n<li>\n<div id=\"ftn1\">\n<p class=\"FootnoteFootnotes\" style=\"text-align: justify; letter-spacing: 0.1pt;\"><sup><a title=\"\" href=\"#_ftnref1\" name=\"_ftn1\"><\/a><\/sup><\/p>\n<p>* Daliana Coban est avocate chez Torys LLP et exerce dans le domaine de pratique de la r\u00e8glementation de l\u2019\u00e9nergie. Avant de rallier les rangs de Torys, Daliana \u00e9tait directrice des applications r\u00e8glementaires et du soutien op\u00e9rationnel chez Toronto Hydro. Forte de plus d\u2019une d\u00e9cennie d\u2019exp\u00e9rience dans le secteur r\u00e8glement\u00e9 de l\u2019\u00e9lectricit\u00e9, elle offre des conseils pratiques sur un large \u00e9ventail de questions r\u00e8glementaires complexes, notamment dans les domaines du droit public et administratif, de la r\u00e8glementation \u00e9conomique et de la conformit\u00e9 r\u00e8glementaire.<\/p>\n<p class=\"FootnoteFootnotes\" style=\"text-align: justify; letter-spacing: 0.1pt;\">Daniel Gralnick est associ\u00e9 principal chez Torys LLP et exerce dans le domaine de pratique de la r\u00e8glementation de l\u2019\u00e9nergie.
