L\u2019Installation est une centrale qui recoure \u00e0 la technologie de valorisation \u00e9nerg\u00e9tique des d\u00e9chets, combin\u00e9e \u00e0 la technologie de captage et de stockage du carbone. La Commission a conclu que l\u2019approbation de l\u2019Installation est \u00ab\u00a0dans l\u2019int\u00e9r\u00eat public compte tenu de ses retomb\u00e9es sur les plans social, \u00e9conomique, environnemental et autre\u00a0\u00bb [traduction] et conforme \u00e0 l\u2019article\u00a017 de l\u2019<span class=\"Italic\" style=\"font-style: italic;\">Alberta Utilities Commission Act<\/span><sup><a title=\"\" href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a><\/sup>. Faits<\/span><\/p>\n<p class=\"BodyJustifiedMain\" style=\"text-align: justify; letter-spacing: 0.1pt; font-style: normal; font-variant-ligatures: normal; font-variant-caps: normal; font-weight: 400; orphans: 2; text-indent: 0px; text-transform: none; widows: 2; word-spacing: 0px; -webkit-text-stroke-width: 0px; white-space: normal; text-decoration-thickness: initial; text-decoration-style: initial; text-decoration-color: initial;\"><span lang=\"FR-CA\">La capacit\u00e9 de production totale de l\u2019Installation est de 19,6\u00a0MW, et celle-ci sera aliment\u00e9e par environ 205\u00a0000\u00a0tonnes de d\u00e9chets solides municipaux par ann\u00e9e provenant de la ville d\u2019Edmonton<sup><a title=\"\" href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a><\/sup>. Les bornes du g\u00e9n\u00e9rateur de l\u2019Installation exporteront 5,8\u00a0MW vers le syst\u00e8me \u00e9lectrique interconnect\u00e9 de l\u2019Alberta, alors que les 10,4\u00a0MW restants alimenteront le syst\u00e8me de captage du carbone de l\u2019Installation<sup><a title=\"\" href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a><\/sup>. Varme Energy Inc. (\u00ab\u00a0Varme\u00a0\u00bb), qui a obtenu l\u2019approbation, pr\u00e9voit d\u2019entreprendre ses travaux de construction au troisi\u00e8me trimestre de 2025 et de proc\u00e9der \u00e0 la mise en service au deuxi\u00e8me trimestre de 2028. L\u2019Installation est-elle conforme \u00e0 la R\u00e8gle 007 de la Commission : \u00ab demandes visant des centrales \u00e9lectriques, des sous-stations, des lignes de transport d\u2019\u00e9lectricit\u00e9, des d\u00e9signations de syst\u00e8mes industriels, des am\u00e9nagements hydro\u00e9lectriques et des gazoducs \u00bb [traduction] ?<\/span><\/p>\n<p class=\"BodyJustifiedMain\" style=\"text-align: justify; letter-spacing: 0.1pt; font-style: normal; font-variant-ligatures: normal; font-variant-caps: normal; font-weight: 400; orphans: 2; text-indent: 0px; text-transform: none; widows: 2; word-spacing: 0px; -webkit-text-stroke-width: 0px; white-space: normal; text-decoration-thickness: initial; text-decoration-style: initial; text-decoration-color: initial;\"><span class=\"Bold\" style=\"font-weight: bold;\"><span lang=\"FR-CA\">La Commission a conclu que l\u2019on avait satisfait aux exigences de la R\u00e8gle\u00a0007, notamment au moyen du programme de mobilisation des participants de Varme.<\/span><\/span><span lang=\"FR-CA\"> Ce programme comprenait la notification et la consultation d\u2019intervenants directement ou n\u00e9gativement touch\u00e9s, comme les propri\u00e9taires fonciers, les occupants et les r\u00e9sidents<sup><a title=\"\" href=\"#_ftn7\" name=\"_ftnref7\">[7]<\/a><\/sup>.<\/span><\/p>\n<p class=\"BodyIndentMain\" style=\"text-align: justify; break-after: avoid; letter-spacing: 0.1pt; font-style: normal; font-variant-ligatures: normal; font-variant-caps: normal; font-weight: 400; orphans: 2; text-indent: 0px; text-transform: none; widows: 2; word-spacing: 0px; -webkit-text-stroke-width: 0px; white-space: normal; text-decoration-thickness: initial; text-decoration-style: initial; text-decoration-color: initial; padding-left: 40px;\"><span lang=\"FR-CA\">b. L\u2019Installation est-elle conforme \u00e0 la R\u00e8gle 012 de la Commission : \u00ab contr\u00f4le du bruit, article 2.7 \u00bb [traduction] ?<\/span><\/p>\n<p class=\"BodyJustifiedMain\" style=\"text-align: justify; letter-spacing: 0.1pt; font-style: normal; font-variant-ligatures: normal; font-variant-caps: normal; font-weight: 400; orphans: 2; text-indent: 0px; text-transform: none; widows: 2; word-spacing: 0px; -webkit-text-stroke-width: 0px; white-space: normal; text-decoration-thickness: initial; text-decoration-style: initial; text-decoration-color: initial;\"><span class=\"Bold\" style=\"font-weight: bold;\"><span lang=\"FR-CA\">L\u2019Installation a \u00e9t\u00e9 jug\u00e9e conforme \u00e0 la R\u00e8gle\u00a0012 ou satisfait aux exigences de la Northeast Capital Industrial Association (NCIA), soit aucune augmentation nette propre au site<\/span><\/span><sup><a title=\"\" href=\"#_ftn8\" name=\"_ftnref8\">[8]<\/a><\/sup><span lang=\"FR-CA\">. La m\u00e9thode g\u00e9n\u00e9ralement accept\u00e9e pour les \u00e9valuations des effets du bruit consiste \u00e0 tenir compte uniquement des niveaux de bruit de l\u2019Installation propos\u00e9e, sans \u00e9valuer les niveaux de bruit en combinaison avec les installations existantes dans la r\u00e9gion de la NCIA<sup><a title=\"\" href=\"#_ftn9\" name=\"_ftnref9\">[9]<\/a><\/sup>. Les niveaux sonores cumulatifs correspondent \u00e0 la somme des niveaux sonores de r\u00e9f\u00e9rence et des niveaux sonores produits par l\u2019Installation<sup><a title=\"\" href=\"#_ftn10\" name=\"_ftnref10\">[10]<\/a><\/sup>. Les niveaux sonores de r\u00e9f\u00e9rence correspondent \u00e0 la somme des niveaux sonores ambiants et des niveaux sonores des installations existantes dans la r\u00e9gion de la NCIA<sup><a title=\"\" href=\"#_ftn11\" name=\"_ftnref11\">[11]<\/a><\/sup>. Certains r\u00e9cepteurs de la r\u00e9gion indiquent d\u00e9j\u00e0 un d\u00e9passement des niveaux sonores permissibles (\u00ab\u00a0NSP\u00a0\u00bb)<sup><a title=\"\" href=\"#_ftn12\" name=\"_ftnref12\">[12]<\/a><\/sup>.<\/span><\/p>\n<p class=\"BodyJustifiedMain\" style=\"text-align: justify; letter-spacing: 0.1pt; font-style: normal; font-variant-ligatures: normal; font-variant-caps: normal; font-weight: 400; orphans: 2; text-indent: 0px; text-transform: none; widows: 2; word-spacing: 0px; -webkit-text-stroke-width: 0px; white-space: normal; text-decoration-thickness: initial; text-decoration-style: initial; text-decoration-color: initial;\"><span lang=\"FR-CA\">La Commission a accept\u00e9 la pr\u00e9diction de l\u2019\u00e9valuation de l\u2019impact du bruit selon laquelle les niveaux sonores de l\u2019Installation propos\u00e9e, combin\u00e9s aux niveaux sonores ambiants, seront conformes aux NSP \u00e0 tous les r\u00e9cepteurs<sup><a title=\"\" href=\"#_ftn13\" name=\"_ftnref13\">[13]<\/a><\/sup>. Cependant, d\u2019apr\u00e8s les r\u00e9sultats pr\u00e9dictifs, les niveaux sonores cumulatifs \u00e9taient conformes \u00e0 la R\u00e8gle\u00a0012 pour tous les r\u00e9cepteurs, sauf pour le r\u00e9cepteur\u00a0R01.<\/span><\/p>\n<p class=\"BodyJustifiedMain\" style=\"text-align: justify; letter-spacing: 0.1pt; font-style: normal; font-variant-ligatures: normal; font-variant-caps: normal; font-weight: 400; orphans: 2; text-indent: 0px; text-transform: none; widows: 2; word-spacing: 0px; -webkit-text-stroke-width: 0px; white-space: normal; text-decoration-thickness: initial; text-decoration-style: initial; text-decoration-color: initial;\"><span lang=\"FR-CA\">\u00c0 ce r\u00e9cepteur, la Commission a reconnu que le niveau sonore cumulatif d\u00e9passe les NSP pendant la nuit parce que le niveau sonore de r\u00e9f\u00e9rence correspondant d\u00e9passe d\u00e9j\u00e0 les NSP acceptables et que l\u2019augmentation du niveau sonore r\u00e9sultant de l\u2019Installation propos\u00e9e ne d\u00e9passe pas 0,4\u00a0d\u00e9cibel<sup><a title=\"\" href=\"#_ftn14\" name=\"_ftnref14\">[14]<\/a><\/sup>. Dans ce cas, la Commission a conclu que l\u2019exigence de la Commission, assortissant son approbation du plan r\u00e9gional de gestion du bruit de la NCIA, pouvait s\u2019appliquer<sup><a title=\"\" href=\"#_ftn15\" name=\"_ftnref15\">[15]<\/a><\/sup>. L\u2019exigence a \u00e9t\u00e9 \u00e9labor\u00e9e en r\u00e9ponse aux pr\u00e9occupations de la NCIA selon lesquelles le d\u00e9veloppement dans les secteurs en p\u00e9riph\u00e9rie de la zone du mod\u00e8le de bruit r\u00e9gional ne serait pas autoris\u00e9 si les installations propos\u00e9es entra\u00eenaient une augmentation des niveaux de bruit de fond dans la r\u00e9gion<sup><a title=\"\" href=\"#_ftn16\" name=\"_ftnref16\">[16]<\/a><\/sup>. La Commission a r\u00e9pondu dans une lettre dat\u00e9e du 16\u00a0octobre\u00a02023 qu\u2019il ne devrait pas y avoir d\u2019augmentation nette du son par rapport au sc\u00e9nario de r\u00e9f\u00e9rence aux r\u00e9cepteurs \u00e0 proximit\u00e9 dans les cas o\u00f9 la R\u00e8gle\u00a0012 n\u2019est pas respect\u00e9e<sup><a title=\"\" href=\"#_ftn17\" name=\"_ftnref17\">[17]<\/a><\/sup>.<\/span><\/p>\n<p class=\"BodyJustifiedMain\" style=\"text-align: justify; letter-spacing: 0.1pt; font-style: normal; font-variant-ligatures: normal; font-variant-caps: normal; font-weight: 400; orphans: 2; text-indent: 0px; text-transform: none; widows: 2; word-spacing: 0px; -webkit-text-stroke-width: 0px; white-space: normal; text-decoration-thickness: initial; text-decoration-style: initial; text-decoration-color: initial;\"><span lang=\"FR-CA\">Dans les circonstances, la Commission a conclu que le bruit provenant de l\u2019Installation devrait \u00eatre conforme aux NSP de la R\u00e8gle\u00a0012 ou satisfaire \u00e0 l\u2019exigence consistant en aucune augmentation nette pour le plan r\u00e9gional de gestion du bruit de la NCIA<sup><a title=\"\" href=\"#_ftn18\" name=\"_ftnref18\">[18]<\/a><\/sup>.<\/span><\/p>\n<p class=\"BodyIndentMain\" style=\"text-align: justify; break-after: avoid; letter-spacing: 0.1pt; font-style: normal; font-variant-ligatures: normal; font-variant-caps: normal; font-weight: 400; orphans: 2; text-indent: 0px; text-transform: none; widows: 2; word-spacing: 0px; -webkit-text-stroke-width: 0px; white-space: normal; text-decoration-thickness: initial; text-decoration-style: initial; text-decoration-color: initial; padding-left: 40px;\"><span lang=\"FR-CA\">c. L\u2019Installation est-elle conforme \u00e0 l\u2019<span class=\"Italic\" style=\"font-style: italic;\">Alberta Wetland Mitigation Directive\u00a0?<\/span><\/span><\/p>\n<p class=\"BodyJustifiedMain\" style=\"text-align: justify; letter-spacing: 0.1pt; font-style: normal; font-variant-ligatures: normal; font-variant-caps: normal; font-weight: 400; orphans: 2; text-indent: 0px; text-transform: none; widows: 2; word-spacing: 0px; -webkit-text-stroke-width: 0px; white-space: normal; text-decoration-thickness: initial; text-decoration-style: initial; text-decoration-color: initial;\"><span class=\"Bold\" style=\"font-weight: bold;\"><span lang=\"FR-CA\">L\u2019Installation a \u00e9t\u00e9 jug\u00e9e conforme \u00e0 l\u2019<\/span><\/span><span class=\"BoldItalic\" style=\"font-weight: bold; font-style: italic;\"><span lang=\"FR-CA\">Alberta Wetland Mitigation Directive<\/span><\/span><sup><a title=\"\" href=\"#_ftn19\" name=\"_ftnref19\">[19]<\/a><\/sup><span lang=\"FR-CA\">. La Commission a accept\u00e9 les observations de Varme selon lesquelles l\u2019Installation \u00e9tait con\u00e7ue pour \u00eatre aussi petite que possible afin de r\u00e9duire au minimum les r\u00e9percussions sur les terres humides; que le choix de l\u2019emplacement de l\u2019Installation dans la zone industrielle d\u00e9sign\u00e9e de Heartland limite n\u00e9cessairement les r\u00e9percussions sur les terres humides; et que des compensations pour les milieux humides seraient vers\u00e9es<sup><a title=\"\" href=\"#_ftn20\" name=\"_ftnref20\">[20]<\/a><\/sup>.<\/span><\/p>\n<p class=\"BodyJustifiedMain\" style=\"text-align: justify; letter-spacing: 0.1pt; font-style: normal; font-variant-ligatures: normal; font-variant-caps: normal; font-weight: 400; orphans: 2; text-indent: 0px; text-transform: none; widows: 2; word-spacing: 0px; -webkit-text-stroke-width: 0px; white-space: normal; text-decoration-thickness: initial; text-decoration-style: initial; text-decoration-color: initial;\"><span lang=\"FR-CA\">En outre, la Commission a impos\u00e9 la condition selon laquelle l\u2019approbation du projet en vertu de la <span class=\"Italic\" style=\"font-style: italic;\">Water Act<\/span>, que fait respecter le minist\u00e8re de l\u2019environnement et des aires prot\u00e9g\u00e9es de l\u2019Alberta (Alberta Environment and Protected Areas [\u00ab\u00a0AEPA\u00a0\u00bb]), devra \u00eatre d\u00e9pos\u00e9e aupr\u00e8s de la Commission lorsqu\u2019elle sera \u00e9mise et doit comprendre le rapport d\u2019\u00e9valuation des r\u00e9percussions sur les terres humides pr\u00e9sent\u00e9 \u00e0 ce minist\u00e8re<sup><a title=\"\" href=\"#_ftn21\" name=\"_ftnref21\">[21]<\/a><\/sup>.<\/span><\/p>\n<p class=\"BodyIndentMain\" style=\"text-align: justify; break-after: avoid; letter-spacing: 0.1pt; font-style: normal; font-variant-ligatures: normal; font-variant-caps: normal; font-weight: 400; orphans: 2; text-indent: 0px; text-transform: none; widows: 2; word-spacing: 0px; -webkit-text-stroke-width: 0px; white-space: normal; text-decoration-thickness: initial; text-decoration-style: initial; text-decoration-color: initial; padding-left: 40px;\"><span lang=\"FR-CA\">d. Quelles sont les r\u00e9percussions sur la qualit\u00e9 de l\u2019air dans la r\u00e9gion ?<\/span><\/p>\n<p class=\"BodyJustifiedMain\" style=\"text-align: justify; letter-spacing: 0.1pt; font-style: normal; font-variant-ligatures: normal; font-variant-caps: normal; font-weight: 400; orphans: 2; text-indent: 0px; text-transform: none; widows: 2; word-spacing: 0px; -webkit-text-stroke-width: 0px; white-space: normal; text-decoration-thickness: initial; text-decoration-style: initial; text-decoration-color: initial;\"><span class=\"Bold\" style=\"font-weight: bold;\"><span lang=\"FR-CA\">La Commission a reconnu que les limites d\u2019\u00e9missions propres au site sont assujetties \u00e0 l\u2019approbation de l\u2019AEPA en vertu de l\u2019<\/span><\/span><span class=\"BoldItalic\" style=\"font-weight: bold; font-style: italic;\"><span lang=\"FR-CA\">Environmental\u00a0Protection and Enhancement Act<\/span><\/span><span class=\"Bold\" style=\"font-weight: bold;\"><span lang=\"FR-CA\"> (\u00ab <\/span><\/span><span class=\"BoldItalic\" style=\"font-weight: bold; font-style: italic;\"><span lang=\"FR-CA\">EPEA<\/span><\/span><span class=\"Bold\" style=\"font-weight: bold;\"><span lang=\"FR-CA\"> \u00bb) parce que l\u2019Installation utilise des d\u00e9chets municipaux comme source de combustible<\/span><\/span><sup><a title=\"\" href=\"#_ftn22\" name=\"_ftnref22\">[22]<\/a><\/sup><span lang=\"FR-CA\">. L\u2019utilisation de d\u00e9chets municipaux rend inapplicables certaines normes courantes sur les \u00e9missions atmosph\u00e9riques<sup><a title=\"\" href=\"#_ftn23\" name=\"_ftnref23\">[23]<\/a><\/sup>. Plus particuli\u00e8rement, les limites du <span class=\"Italic\" style=\"font-style: italic;\">R\u00e8glement multisectoriel sur les polluants atmosph\u00e9riques <\/span>relatives aux \u00e9missions de NO<sub>x<\/sub> ne s\u2019appliquent qu\u2019aux fournaises aliment\u00e9es par des combustibles fossiles gazeux<sup><a title=\"\" href=\"#_ftn24\" name=\"_ftnref24\">[24]<\/a><\/sup>. Pour la m\u00eame raison, les exigences relatives aux \u00e9missions de NO<sub>x<\/sub> \u00e9nonc\u00e9es dans l\u2019<span class=\"Italic\" style=\"font-style: italic;\">Air Emissions Requirement Policy for the Industrial Heartland Designated Industrial Zone <\/span>ne s\u2019appliquent pas<sup><a title=\"\" href=\"#_ftn25\" name=\"_ftnref25\">[25]<\/a><\/sup>. On traite ci-dessous du d\u00e9clenchement du processus d\u2019approbation en vertu de l\u2019<span class=\"Italic\" style=\"font-style: italic;\">Environmental\u00a0Protection and Enhancement Act<\/span>.<\/span><\/p>\n<p class=\"BodyJustifiedMain\" style=\"text-align: justify; letter-spacing: 0.1pt; font-style: normal; font-variant-ligatures: normal; font-variant-caps: normal; font-weight: 400; orphans: 2; text-indent: 0px; text-transform: none; widows: 2; word-spacing: 0px; -webkit-text-stroke-width: 0px; white-space: normal; text-decoration-thickness: initial; text-decoration-style: initial; text-decoration-color: initial;\"><span lang=\"FR-CA\">Le rapport sur la qualit\u00e9 de l\u2019air pr\u00e9sent\u00e9 par Varme pr\u00e9disait les r\u00e9percussions attendues de l\u2019Installation et a \u00e9t\u00e9 accept\u00e9 par la Commission<sup><a title=\"\" href=\"#_ftn26\" name=\"_ftnref26\">[26]<\/a><\/sup>. La Commission a accept\u00e9 l\u2019observation de Varme selon laquelle la garantie de remise en \u00e9tat de l\u2019Installation doit \u00eatre fournie \u00e0 l\u2019AEPA\u00a0conform\u00e9ment au <span class=\"Italic\" style=\"font-style: italic;\">Waste Control Regulation <\/span>pris en vertu de l\u2019<span class=\"Italic\" style=\"font-style: italic;\">Environmental\u00a0Protection and Enhancement Act<\/span><sup><a title=\"\" href=\"#_ftn33\" name=\"_ftnref33\">[33]<\/a><\/sup>.
