{"id":3417,"date":"2021-07-07T13:15:25","date_gmt":"2021-07-07T13:15:25","guid":{"rendered":"https:\/\/energyregulationquarterly.ca\/?p=3417"},"modified":"2022-06-24T14:15:05","modified_gmt":"2022-06-24T14:15:05","slug":"editorial-19","status":"publish","type":"post","link":"https:\/\/energyregulationquarterly.ca\/fr\/editorials\/editorial-19","title":{"rendered":"\u00c9ditorial"},"content":{"rendered":"<p>La poursuite de l\u2019objectif primordial de nombreux gouvernements, \u00e0 savoir la transition vers une \u00e9conomie \u00e0 faible \u00e9mission de carbone, d\u00e9pend fortement de l\u2019innovation, soit l\u2019innovation technologique, l\u2019innovation dans le traitement r\u00e9glementaire des d\u00e9veloppements technologiques et l\u2019innovation par les responsables de la r\u00e9glementation eux-m\u00eames dans leur approche face \u00e0 de nouveaux d\u00e9fis. Ce num\u00e9ro de la <em>Publication trimestrielle sur la r\u00e8glementation de l\u2019\u00e9nergie <\/em>porte sur ce th\u00e8me.<\/p>\n<p>Dans \u00ab\u00a0Les organismes canadiens de r\u00e9glementation de l\u2019\u00e9nergie et les nouvelles technologies\u00a0\u00bb, Gordon\u00a0Kaiser observe que les organismes canadiens de r\u00e9glementation de l\u2019\u00e9nergie ont \u00e9t\u00e9 r\u00e9ticents \u00e0 financer au moyen de tarifs des projets exp\u00e9rimentaux ou de recherche, citant comme exemple le refus de demandes de financement pour la recharge des v\u00e9hicules \u00e9lectriques. En\u00a02020 cependant, les organismes de r\u00e9glementation de la Colombie-Britannique, de l\u2019Ontario et de la Nouvelle-\u00c9cosse ont pris des mesures pour promouvoir de nouvelles technologies \u00e0 l\u2019aide de projets pilotes. M. Kaiser passe en revue ces d\u00e9veloppements. Il note que les gouvernements se tournent vers leurs organismes de r\u00e9glementation de l\u2019\u00e9nergie pour \u00ab\u00a0montrer la voie\u00a0\u00bb, soulignant la r\u00e9cente modification de la <em>Loi sur la Commission de l\u2019\u00e9nergie de l\u2019Ontario <\/em>pour inclure parmi les objectifs de la Commission celui de \u00ab\u00a0[f]aciliter l\u2019innovation dans le secteur de l\u2019\u00e9lectricit\u00e9<sup>[1]<\/sup>\u00a0\u00bb.<\/p>\n<p>L\u2019innovation technologique sous la forme d\u2019installations toujours plus nombreuses de panneaux solaires sur les toits par les consommateurs est \u00e9galement \u00e0 l\u2019origine des d\u00e9fis r\u00e9glementaires abord\u00e9s par Ahmad Faruqui <em>et al. <\/em>dans \u00ab\u00a0Les luttes d\u2019id\u00e9es \u00e0 propos de la facturation nette de l\u2019\u00e9nergie\u00a0\u00bb. Bien que le corps de l\u2019article traite du sujet dans le contexte de la mise en \u0153uvre g\u00e9n\u00e9ralis\u00e9e de la FNE aux \u00c9tats-Unis, on y aborde aussi les perspectives notables de l\u2019Ontario, de l\u2019Alberta et de la Colombie-Britannique.<\/p>\n<p>En plus des d\u00e9fis r\u00e9glementaires que posent les d\u00e9veloppements technologiques, il faudra \u00e9galement innover dans les approches des organismes de r\u00e9glementation pour relever ces d\u00e9fis. La recherche en cours dans le cadre du projet \u00c9nergie positive de l\u2019Universit\u00e9 d\u2019Ottawa vise \u00e0 aider les organismes de r\u00e9glementation, et d\u2019autres organismes, \u00e0 relever ces d\u00e9fis. En particulier, \u00c9nergie positive a entrepris un projet de recherche en collaboration avec l\u2019Association canadienne des membres des tribunaux d\u2019utilit\u00e9 publique (CAMPUT), dans le cadre duquel plusieurs innovations r\u00e9ussies et possibilit\u00e9s \u00ab\u00a0pour favoriser davantage l\u2019innovation dans la prise de d\u00e9cisions r\u00e9glementaires visant le secteur de l\u2019\u00e9nergie\u00a0\u00bb ont \u00e9t\u00e9 d\u00e9gag\u00e9es. Deux \u00e9tudes de cas r\u00e9alis\u00e9es au cours de ce projet sont abord\u00e9es dans l\u2019ouvrage de Patricia\u00a0Larkin intitul\u00e9 \u00ab\u00a0Que pouvons-nous apprendre des innovations dans le milieu de la r\u00e9glementation de l\u2019\u00e9nergie? \u00c9tudes de cas d\u2019accords r\u00e9glementaires formels et de processus de participation publique\u00a0\u00bb.<\/p>\n<p>Les d\u00e9fis pr\u00e9sent\u00e9s par ces innovations technologiques et r\u00e9glementaires s\u2019inscrivent dans un cadre politique\/juridique plus large \u2014 la recherche d\u2019un juste \u00e9quilibre entre les r\u00f4les respectifs des d\u00e9cideurs politiques et des organismes de r\u00e9glementation continue de repr\u00e9senter un d\u00e9fi permanent. Dans \u00ab\u00a0Le r\u00f4le \u00e9largi des dirigeants politiques dans l\u2019examen des projets de pipelines f\u00e9d\u00e9raux propos\u00e9s : une \u00e9tude de cas\u00a0\u00bb, Rowland\u00a0Harrison examine une proc\u00e9dure r\u00e9cente dans laquelle le Cabinet f\u00e9d\u00e9ral a ajout\u00e9 \u00e0 son approbation d\u2019un projet une condition qui avait \u00e9t\u00e9 express\u00e9ment rejet\u00e9e par la R\u00e9gie de l\u2019\u00e9nergie du Canada (REC) dans sa recommandation au Cabinet. Le Cabinet a conclu qu\u2019il pouvait am\u00e9liorer et renforcer les recommandations de la REC sur une question qui ne semblait pas \u00eatre une question d\u2019int\u00e9r\u00eat national primordial et qui relevait sans doute de l\u2019expertise de la REC.<\/p>\n<p>Le r\u00e9cent avis de renvoi de la Cour supr\u00eame du Canada sur les contestations de la constitutionnalit\u00e9 de la loi du gouvernement f\u00e9d\u00e9ral sur la taxe sur le carbone a des implications fondamentales \u00e9videntes pour le d\u00e9veloppement continu des initiatives politiques et l\u00e9gislatives visant la transition vers une \u00e9conomie \u00e0 faible \u00e9mission de carbone.
