Cependant, ce r\u00f4le semble parfois incoh\u00e9rent, voire contradictoire. D\u2019une part, le gaz naturel \u00e9tant le combustible hydrocarbon\u00e9 le plus propre et le moins \u00e9metteur de carbone, son utilisation est souvent pr\u00e9sent\u00e9e comme un \u00ab\u00a0combustible de transition\u00a0\u00bb, en particulier pour remplacer le charbon. D\u2019autre part, certains plans visant \u00e0 r\u00e9duire les \u00e9missions de carbone incluent la r\u00e9duction directe de l\u2019utilisation du gaz naturel lui-m\u00eame. Par exemple, comme le relatent Christopher Bystrom et Madison Grist dans l\u2019article principal de ce num\u00e9ro de la <em>Publication trimestrielle sur la r\u00e9glementation de l\u2019\u00e9nergie <\/em>(<em>ERQ<\/em>) intitul\u00e9 \u00ab\u00a0L\u2019avenir des services publics du gaz dans un monde \u00e0 faible \u00e9mission de carbone : Le premier fonds d\u2019innovation vert administr\u00e9 par un service public au Canada\u00a0\u00bb, le plan CleanBC de la Colombie-Britannique pr\u00e9voit une r\u00e9duction de 40\u00a0% de la consommation de gaz naturel au cours des dix prochaines ann\u00e9es et encourage l\u2019\u00e9lectrification. Ces plans poseront sans doute de nombreux probl\u00e8mes aux organismes de r\u00e9glementation de l\u2019\u00e9nergie, comme l\u2019illustre l\u2019expos\u00e9 des auteurs sur la r\u00e9cente approbation par la British Columbia Utilities Commission du Clean Growth Innovation Fund de FortisBC Energy Inc. qui sera financ\u00e9 par les clients et administr\u00e9 par le service public de 2020 \u00e0 2024.<\/p>\n<p>L\u2019impact direct et imm\u00e9diat de Fort McMurray en 2016 a \u00e9t\u00e9 d\u00e9vastateur. Il s\u2019agit toujours de la catastrophe naturelle la plus co\u00fbteuse de l\u2019histoire du Canada \u2014 et les retomb\u00e9es se poursuivent dans le domaine de la r\u00e9glementation \u00e9nerg\u00e9tique. Dans \u00ab\u00a0Les projets li\u00e9s aux ressources et l\u2019honneur de la Couronne\u00a0\u00bb, Martin Ignasiak, Sander Duncanson et Jesse Baker examinent deux d\u00e9cisions r\u00e9centes. La premi\u00e8re, par la Cour d\u2019appel de l\u2019Alberta, a conclu que l\u2019organisme de r\u00e9gulation de l\u2019Alberta Energy Regulator (AER) avait ind\u00fbment omis de consid\u00e9rer l\u2019honneur de la Couronne comme distinct de l\u2019obligation de consultation sur un projet de sables bitumineux. La seconde, par la Cour supr\u00eame de la Nouvelle-\u00c9cosse, a conclu que le ministre provincial de l\u2019Environnement avait ind\u00fbment omis de mener une consultation sur les droits et titres autochtones revendiqu\u00e9s au-del\u00e0 de l\u2019\u00e9tendue des impacts physiques d\u2019un projet gazier propos\u00e9.<\/p>\n<p>Cependant, toutes les questions relatives aux relations avec les peuples indig\u00e8nes et pertinentes pour les organismes de r\u00e9glementation de l\u2019\u00e9nergie ne d\u00e9coulent pas de l\u2019obligation de consulter. En commentant une r\u00e9cente d\u00e9cision de la Cour d\u2019appel du Manitoba qui a annul\u00e9 une d\u00e9cision de la R\u00e9gie des services publics du Manitoba, Patrick Duffy commente que la d\u00e9cision \u00ab\u00a0soul\u00e8ve la question fascinante de savoir comment des principes de longue date de r\u00e9glementation des services publics devraient \u00eatre interpr\u00e9t\u00e9s et appliqu\u00e9s \u00e0 la lumi\u00e8re du besoin reconnu de faire progresser la r\u00e9conciliation entre les peuples autochtones et non autochtones\u00a0\u00bb.<\/p>\n<p>Le dernier commentaire de ce num\u00e9ro de l\u2019<em>ERQ<\/em>, par Marie Buchinski et Stephanie Ridge, passe en revue une r\u00e9cente d\u00e9cision de la R\u00e9gie de l\u2019\u00e9nergie du Canada (REC) rejetant une demande de NOVA Gas Transmission Ltd. (NGTL) visant \u00e0 obtenir une autorisation de cessation d\u2019exploitation des installations qui font partie du vaste r\u00e9seau de pipelines et d\u2019installations de NGTL en Alberta. Bien que la d\u00e9cision ait \u00e9t\u00e9 sp\u00e9cifique \u00e0 la demande de NGTL, les auteurs notent qu\u2019elle fournit des orientations \u00e0 tous les promoteurs qui pourraient envisager de pr\u00e9senter une demande d\u2019autorisation de cessation d\u2019exploitation d\u2019installations r\u00e9glement\u00e9es par la REC.
