Dans l\u2019article principal de ce num\u00e9ro de la <em>Publication trimestrielle sur la r\u00e8glementation de l\u2019\u00e9nergie<\/em>, \u00ab\u00a0L\u2019histoire de deux mod\u00e8les de march\u00e9 : Quoi de neuf en Alberta?\u00a0\u00bb, Bob Heggie discute de l\u2019initiative actuelle visant \u00e0 remodeler le r\u00f4le des forces du march\u00e9 dans le march\u00e9 de gros de l\u2019\u00e9lectricit\u00e9 par l\u2019introduction d\u2019un march\u00e9 de capacit\u00e9 administr\u00e9, tandis que l\u2019Alberta Utilities Commission examine si et comment les forces du march\u00e9 peuvent \u00eatre mises \u00e0 contribution dans la fonction traditionnelle monopolistique des infrastructures de distribution. Au c\u0153ur de l\u2019exercice se trouve la question \u00e9ternelle de la r\u00e8glementation \u00e9conomique : quels \u00e9l\u00e9ments fonctionnels du syst\u00e8me peuvent \u00eatre confi\u00e9s \u00e0 des march\u00e9s concurrentiels et lesquels doivent \u00eatre consid\u00e9r\u00e9s comme des fonctions monopolistiques? Heggie conclut que, quelque peu paradoxalement, \u00ab\u00a0l\u2019\u00e9volution en Alberta s\u2019oriente vers l\u2019introduction d\u2019un contr\u00f4le plus central dans ce qui \u00e9tait autrefois une fonction intrins\u00e8quement concurrentielle, tout en introduisant potentiellement des forces concurrentielles dans ce qui \u00e9tait une fonction intrins\u00e8quement monopolistique\u00a0\u00bb.<\/p>\n<p>Le d\u00e9fi de bien d\u00e9finir le r\u00f4le du gouvernement dans la gouvernance du secteur de l\u2019\u00e9lectricit\u00e9 fait \u00e9galement l\u2019objet d\u2019un article de Robert Warren intitul\u00e9 \u00ab\u00a0Les cas Avista et East-West Tie et leurs implications pour la r\u00e9gie du secteur de l\u2019\u00e9lectricit\u00e9 en Ontario\u00a0\u00bb. Selon Warren, ces deux cas<sup>1<\/sup> \u00ab\u00a0ont mis en lumi\u00e8re une grave faiblesse dans la gouvernance du secteur de l\u2019\u00e9lectricit\u00e9 en Ontario [et] illustrent non seulement les effets n\u00e9gatifs imm\u00e9diats de l\u2019ing\u00e9rence du gouvernement dans des questions pr\u00e9cises, mais aussi les dommages plus graves que le r\u00f4le du gouvernement cause \u00e0 la gouvernance du secteur dans son ensemble\u00a0\u00bb.<\/p>\n<p>Entre-temps, la r\u00e8glementation quotidienne du secteur de l\u2019\u00e9lectricit\u00e9 se poursuit. Dans \u00ab\u00a0OEB Takes Steps Towards Implementing \u201cActivity and Program Based Benchmarking\u201d\u00a0\u00bb (la CEO prend des mesures vers la mise en \u0153uvre de l\u2019\u00ab\u00a0analyse comparative ax\u00e9e sur les activit\u00e9s et les programmes\u00a0\u00bb), David Stevens passe en revue le document de travail r\u00e9cemment publi\u00e9 par la Commission de l\u2019\u00e9nergie de l\u2019Ontario. Il note que, bien que le document de travail lui-m\u00eame se limite \u00e0 l\u2019application de l\u2019approche d\u2019analyse ax\u00e9e sur les activit\u00e9s et les programmes aux distributeurs d\u2019\u00e9lectricit\u00e9, la CEO pr\u00e9voit mettre en \u0153uvre cette approche pour tous les services publics r\u00e8glement\u00e9s, y compris les distributeurs de gaz.<\/p>\n<p>Dans \u00ab\u00a0Incompatibilit\u00e9 avec l\u2019int\u00e9r\u00eat public\u00a0: les trois d\u00e9cennies d\u2019\u00e9gard de la FERC pour la consolidation des services d\u2019\u00e9lectricit\u00e9\u00a0\u00bb, Scott Hempling remet en question l\u2019approche de la Federal Energy Regulatory Commission (FERC) concernant l\u2019approbation des fusions et des acquisitions de services publics d\u2019\u00e9lectricit\u00e9 au d\u00e9tail aux \u00c9tats-Unis, notant que le nombre de services publics ind\u00e9pendants d\u2019\u00e9lectricit\u00e9 au d\u00e9tail a \u00e9t\u00e9 r\u00e9duit de plus de moiti\u00e9 depuis le milieu des ann\u00e9es 1980. Bien que la FERC soit tenue par la Loi de conclure que les op\u00e9rations de consolidation sont \u00ab\u00a0conformes \u00e0 l\u2019int\u00e9r\u00eat public\u00a0\u00bb, les ordonnances de la FERC n\u2019exigent en fait qu\u2019il n\u2019y ait \u00ab\u00a0aucun pr\u00e9judice\u00a0\u00bb. Hempling se demande s\u2019il s\u2019agit de la bonne norme, ce qui donne \u00e0 penser que, conform\u00e9ment \u00e0 la norme de l\u2019int\u00e9r\u00eat public, il faudrait peut-\u00eatre mettre davantage l\u2019accent sur la question de savoir si les march\u00e9s pertinents r\u00e9sultant de la consolidation des op\u00e9rations sont des \u00ab\u00a0march\u00e9s effectivement concurrentiels\u00a0\u00bb.<\/p>\n<p>Depuis les derni\u00e8res d\u00e9cennies du si\u00e8cle dernier, les march\u00e9s de l\u2019\u00e9nergie se sont caract\u00e9ris\u00e9s par des changements structurels fondamentaux, des innovations techniques et d\u2019autres changements dynamiques. Dans son article intitul\u00e9 \u00ab\u00a0Comment l\u2019\u00e9volutivit\u00e9 transforme les industries de l\u2019\u00e9nergie\u00a0\u00bb, Adonis Yatchew observe que, pendant une grande partie du XX<sup>e<\/sup> si\u00e8cle, la force dominante qui a fa\u00e7onn\u00e9 la structure des industries de l\u2019\u00e9nergie a \u00e9t\u00e9 \u00ab\u00a0l\u2019augmentation des \u00e9conomies d\u2019\u00e9chelle\u00a0\u00bb. Au XXI<sup>e<\/sup> si\u00e8cle, la tendance s\u2019est invers\u00e9e, vers une \u00ab\u00a0\u00e9volutivit\u00e9\u00a0\u00bb. Par exemple, de l\u2019avis de Yatchew, la capacit\u00e9 de l\u2019Organisation des pays exportateurs de p\u00e9trole (OPEP) d\u2019influencer les prix a \u00e9t\u00e9 min\u00e9e, non pas tant parce que la fracturation a ouvert de nouveaux approvisionnements, mais parce que les r\u00e9ductions de l\u2019offre provenant des membres de l\u2019OPEP se traduisent par des augmentations r\u00e9ciproques des sources de schistes \u2013 la production de schistes peut \u00eatre mise \u00e0 l\u2019\u00e9chelle pour compenser les r\u00e9ductions de l\u2019offre provenant d\u2019autres sources. \u00ab\u00a0Dans les industries de l\u2019\u00e9lectricit\u00e9, les ressources \u00e9nerg\u00e9tiques distribu\u00e9es <em>hautement \u00e9volutives<\/em>, telles que l\u2019\u00e9olien, le solaire et le stockage, continuent de conna\u00eetre une baisse rapide des co\u00fbts.\u00a0\u00bb Yatchew rel\u00e8ve les sources de pr\u00e9occupation sur le plan r\u00e8glementaire, institutionnel et juridique, comme \u00ab\u00a0la d\u00e9pr\u00e9ciation ou le d\u00e9laissement possible d\u2019actifs, la fiabilit\u00e9 de l\u2019approvisionnement (par exemple dans les march\u00e9s de capacit\u00e9), l\u2019\u00e9volution des tarifs et les d\u00e9fis en mati\u00e8re de co\u00fbts\u00a0\u00bb.<\/p>\n<p>L\u2019importante insuffisance de la capacit\u00e9 des ol\u00e9oducs canadiens continue d\u2019avoir des r\u00e9percussions imm\u00e9diates, graves et identifiables \u2013 sur l\u2019industrie, les recettes publiques et la confiance des investisseurs, avec des r\u00e9percussions sur la croissance \u00e0 long terme de l\u2019industrie p\u00e9troli\u00e8re canadienne. La solution \u00e9vidente \u2013 ajouter de la capacit\u00e9 \u2013 ne sera pas disponible \u00e0 court terme, car chacun des trois grands projets d\u2019ol\u00e9oducs (agrandissement de Trans Mountain, remplacement de la canalisation 3 d\u2019Enbridge et KXL) continue de subir divers retards d\u2019ordre juridique et r\u00e8glementaire et li\u00e9s \u00e0 la d\u00e9livrance de permis. En novembre 2018, le ministre des Ressources naturelles a demand\u00e9 conseil \u00e0 l\u2019Office national de l\u2019\u00e9nergie sur ce qui pourrait \u00eatre fait entre-temps pour optimiser l\u2019utilisation de la capacit\u00e9 pipelini\u00e8re actuelle. Dans son rapport de mars intitul\u00e9 \u00ab\u00a0Optimisation des capacit\u00e9s pipelini\u00e8re et ferroviaire pour le transport de p\u00e9trole hors de l\u2019Ouest canadien\u00a0\u00bb, l\u2019Office a not\u00e9 que les pipelines fonctionnent actuellement \u00ab\u00a0au maximum de leur capacit\u00e9 [et que pour] accro\u00eetre le d\u00e9bit de mani\u00e8re importante [\u2026] il faudrait [\u2026] en augmenter la capacit\u00e9.\u00a0\u00bb. L\u2019Office a toutefois fait des suggestions quant aux mesures non r\u00e8glementaires qui pourraient \u00eatre prises dans l\u2019intervalle pour am\u00e9liorer le processus de mise en candidature pour la capacit\u00e9. Rowland Harrison, l\u2019un de nos cor\u00e9dacteurs en chef, commente.<\/p>\n<p>Les contraintes actuelles de la capacit\u00e9 des ol\u00e9oducs et leurs r\u00e9percussions directes sur la mise en valeur actuelle et future des sables bitumineux de l\u2019Alberta font bien s\u00fbr l\u2019objet de reportages et de commentaires presque quotidiens. Trois livres en ont r\u00e9sult\u00e9, dont le plus r\u00e9cent, <em>THE PATCH\u00a0: The People, Pipelines, and Politics of the Oil Sands<\/em> par Chris Turner, est comment\u00e9 par Rowland Harrison<sup>2<\/sup>.
