{"id":2278,"date":"2018-12-17T16:30:09","date_gmt":"2018-12-17T16:30:09","guid":{"rendered":"http:\/\/www.energyregulationquarterly.ca\/?p=2278"},"modified":"2022-06-24T15:21:35","modified_gmt":"2022-06-24T15:21:35","slug":"editorial-17-2-2-2","status":"publish","type":"post","link":"https:\/\/energyregulationquarterly.ca\/fr\/editorials\/editorial-17-2-2-2","title":{"rendered":"\u00c9ditorial"},"content":{"rendered":"<p>Les politiques publiques sont trop souvent motiv\u00e9es par un besoin per\u00e7u de r\u00e9agir d\u2019urgence \u00e0 une \u00ab\u00a0crise\u00a0\u00bb \u2013 de montrer que l\u2019on fait \u00ab\u00a0quelque chose\u00a0\u00bb.\u00a0 L\u2019analyse de la nature r\u00e9elle du probl\u00e8me n\u2019est parfois pas suffisamment prise en compte, de sorte que les r\u00e9ponses l\u00e9gislatives et r\u00e8glementaires sont souvent trop ambitieuses.<\/p>\n<p>L\u2019avenir nous dira si cela pourrait \u00eatre le cas avec le projet de loi C-69 dont le Parlement est actuellement saisi et qui (en supposant qu\u2019il devienne loi) abolirait l\u2019Office national de l\u2019\u00e9nergie (ONE) et le remplacerait par un organisme canadien tr\u00e8s diff\u00e9rent. La responsabilit\u00e9 premi\u00e8re de l\u2019examen des projets d\u2019infrastructure \u00e9nerg\u00e9tique f\u00e9d\u00e9raux propos\u00e9s incomberait \u00e0 une nouvelle agence d\u2019\u00e9valuation des r\u00e9percussions (en r\u00e9alit\u00e9, une refonte et un \u00e9largissement du mandat de l\u2019Agence canadienne d\u2019\u00e9valuation environnementale), dont les d\u00e9cisions finales seraient prises par le ministre ou le gouverneur en conseil. Le projet de loi C-69 est la r\u00e9ponse du gouvernement \u00e0 son engagement de \u00ab\u00a0moderniser\u00a0\u00bb l\u2019ONE, mais il va bien au-del\u00e0. La pr\u00e9misse sous-jacente est que le cadre et le processus de r\u00e8glementation actuels de l\u2019ONE sont \u00ab\u00a0bris\u00e9s\u00a0\u00bb.<\/p>\n<p>L\u2019\u00e9quipe de recherche du projet \u00c9nergie positive de l\u2019Universit\u00e9 d\u2019Ottawa ne pense pas que le syst\u00e8me soit bris\u00e9, mais plut\u00f4t qu\u2019il a besoin d\u2019une \u00ab\u00a0r\u00e9forme \u00e9clair\u00e9e\u00a0\u00bb. Dans le plus r\u00e9cent d\u2019une s\u00e9rie d\u2019articles publi\u00e9s par l\u2019ERQ dans le cadre du projet \u00c9nergie positive, Louis\u00a0Simard soutient que trois concepts principaux \u2013 \u00ab\u00a0engagement, information et capacit\u00e9\u00a0\u00bb \u2013 sont au c\u0153ur de l\u2019objectif d\u2019am\u00e9liorer le processus d\u00e9cisionnel pour atteindre un niveau de confiance accru du public, notamment dans une perspective de \u00ab\u00a0ce qui fonctionne\u00a0\u00bb.<\/p>\n<p>Dans son m\u00e9moire de politique intitul\u00e9 \u00ab\u00a0Perspective historique et comparative des tarifs d\u2019\u00e9lectricit\u00e9 de l\u2019Ontario\u00a0\u00bb, Adam Fremeth pr\u00e9sente une perspective historique et comparative des tarifs d\u2019\u00e9lectricit\u00e9 en Ontario. Il conclut que, m\u00eame s\u2019il ne fait aucun doute que les tarifs d\u2019\u00e9lectricit\u00e9 en Ontario ont augment\u00e9 consid\u00e9rablement au cours de la derni\u00e8re d\u00e9cennie, il y a eu de nombreux \u00e9pisodes historiques de hausses rapides des tarifs \u00e0 court terme suivis de p\u00e9riodes de croissance plus lente et que les \u00c9tats am\u00e9ricains ayant un profil de production semblable \u00e0 celui de l\u2019Ontario ont \u00e9galement connu des hausses tarifaires \u00e0 long terme.<\/p>\n<p>Deux \u00e9v\u00e9nements encourageants se sont produits au cours des derniers mois au milieu des revers dont on a beaucoup parl\u00e9 au sujet des projets de gazoducs propos\u00e9s. La premi\u00e8re est l\u2019annonce faite par Equinor Canada Ltd. (anciennement Statoil Canada Ltd.) et le premier ministre de Terre-Neuve-et-Labrador en juillet d\u2019une entente-cadre pour le d\u00e9veloppement potentiel de la d\u00e9couverte p\u00e9troli\u00e8re de Bay du Nord situ\u00e9e \u00e0 environ 270 milles marins (500 kilom\u00e8tres) au large des c\u00f4tes. Dans \u00ab\u00a0Exploitation p\u00e9troli\u00e8re extrac\u00f4ti\u00e8re en eaux juridiques inexplor\u00e9es : Le projet Bay du Nord pr\u00e9cipitera-t-il un autre conflit f\u00e9d\u00e9ral-provincial? \u00bb, Rowland Harrison (l\u2019un des r\u00e9dacteurs en chef de l\u2019ERQ) examine si un autre diff\u00e9rend f\u00e9d\u00e9ral-provincial au sujet des ressources pourrait survenir.<\/p>\n<p>Le deuxi\u00e8me fait marquant a \u00e9t\u00e9 l\u2019annonce en octobre qu\u2019une d\u00e9cision d\u2019investissement finale avait \u00e9t\u00e9 prise pour aller de l\u2019avant avec le projet d\u2019exportation de GNL de 40 milliards de dollars propos\u00e9 pour Kitimat, en Colombie-Britannique. Gordon Kaiser, \u00e9galement r\u00e9dacteur en chef de l\u2019ERQ, parle de ce d\u00e9veloppement dans \u00ab\u00a0GNL Canada franchit l\u2019obstacle r\u00e8glementaire national\u00a0\u00bb.<\/p>\n<p>Dans \u00ab\u00a0Fusion d\u2019Union Enbridge \u00bb, Patrick Duffy et ses coll\u00e8gues examinent la r\u00e9cente d\u00e9cision de la Commission de l\u2019\u00e9nergie de l\u2019Ontario (CEO) approuvant la fusion propos\u00e9e d\u2019Enbridge Gas Distribution et de Union Gas Limited. Les auteurs font remarquer que la d\u00e9cision est importante pour affirmer que le crit\u00e8re de l\u2019absence de pr\u00e9judice, traditionnellement appliqu\u00e9 dans le secteur de l\u2019\u00e9lectricit\u00e9, peut \u00eatre utilis\u00e9 pour \u00e9valuer les fusions dans le secteur du gaz naturel. Selon eux, la d\u00e9cision t\u00e9moigne \u00e9galement de la volont\u00e9 de la CEO de permettre la monopolisation de l\u2019industrie du gaz naturel en Ontario.<\/p>\n<p>L\u2019offre finale dans ce num\u00e9ro de l\u2019ERQ est une revue par Rowland Harrison du livre r\u00e9cemment publi\u00e9 de Jacques Poitras intitul\u00e9\u00a0: <em>PIPE DREAMS: The Fight for Canada\u2019s Energy Future.
