{"id":2096,"date":"2018-07-05T15:28:43","date_gmt":"2018-07-05T15:28:43","guid":{"rendered":"http:\/\/www.energyregulationquarterly.ca\/?p=2096"},"modified":"2018-07-11T17:30:28","modified_gmt":"2018-07-11T17:30:28","slug":"editorial-17-2","status":"publish","type":"post","link":"https:\/\/energyregulationquarterly.ca\/fr\/editorials\/editorial-17-2","title":{"rendered":"\u00c9ditorial"},"content":{"rendered":"<p>Au moment de mettre sous presse la pr\u00e9sente <em>Publication trimestrielle sur la r\u00e8glementation de l\u2019\u00e9nergie<\/em>,\u00a0 le gouvernement f\u00e9d\u00e9ral pr\u00e9sente des dispositions l\u00e9gislatives qui se traduiront par une restructuration radicale du cadre r\u00e8glementaire qui entoure les projets \u00e9nerg\u00e9tiques d\u2019envergure de comp\u00e9tence f\u00e9d\u00e9rale, y compris, plus particuli\u00e8rement, des gazoducs interprovinciaux et internationaux. Les modifications que propose le projet de loi C-69<sup>1<\/sup>, sous l\u2019appellation anodine <em>Loi \u00e9dictant la Loi sur l\u2019\u00e9valuation d\u2019impact et la Loi sur la R\u00e9gie canadienne de l\u2019\u00e9nergie, modifiant la Loi sur la protection de la navigation et apportant des modifications corr\u00e9latives \u00e0 d\u2019autres lois<\/em>, sont fondamentales; il s\u2019agit de l\u2019initiative f\u00e9d\u00e9rale la plus importante dans le domaine de la r\u00e8glementation de l\u2019\u00e9nergie depuis, \u00e0 tout le moins,\u00a0 l\u2019av\u00e8nement du Programme \u00e9nerg\u00e9tique national en 1980.<\/p>\n<p>Au terme de pr\u00e8s de 60 ans d\u2019existence, l\u2019Office national de l\u2019\u00e9nergie (ONE) serait aboli. Le nouvel organisme canadien de r\u00e8glementation de l\u2019\u00e9nergie qui le remplacerait, la R\u00e9gie canadienne de l\u2019\u00e9nergie,\u00a0 jouerait un r\u00f4le fondamentalement diff\u00e9rent, plus particuli\u00e8rement en ce qui a trait \u00e0 la fa\u00e7on de d\u00e9terminer si de nouveaux projets propos\u00e9s sont dans l\u2019int\u00e9r\u00eat public. Cette d\u00e9termination du seuil serait faite initialement par des commissions conjointes en vertu de la <em>Loi sur l\u2019\u00e9valuation d\u2019impact<\/em>. Qui plus est, la R\u00e9gie canadienne de l\u2019\u00e9nergie fonctionnerait sous la gouverne d\u2019un conseil d\u2019administration qui ressemblerait \u00e0 un conseil d\u2019entreprise. Ses audiences seraient men\u00e9es par des membres d\u2019une \u00ab\u00a0commission\u00a0\u00bb plut\u00f4t que par des membres d\u2019un conseil.<\/p>\n<p>Le pr\u00e9sent num\u00e9ro de la <em>Publication trimestrielle sur la r\u00e8glementation de l\u2019\u00e9nergie<\/em> pr\u00e9sente un examen et une analyse approfondis sur ce vent de changement, \u00e0 commencer par un survol informatif par Martin Olszynski des changements propos\u00e9s, dans son article vedette sur le nouveau r\u00e9gime f\u00e9d\u00e9ral d\u2019\u00e9valuation des projets interprovinciaux de gazoducs\u00a0et la <em>Loi sur l\u2019\u00e9valuation d\u2019impact<\/em> propos\u00e9e. L\u2019article porte sur la mani\u00e8re dont le nouveau r\u00e9gime s\u2019appliquerait \u00e0 des projets propos\u00e9s de gazoducs interprovinciaux et internationaux.<\/p>\n<p>Des changements radicaux aux politiques gouvernementales se produisent rarement en vase clos et ne sont pleinement compris que dans le contexte de leur \u00e9volution et d\u2019\u00e9v\u00e9nements formatifs qui les ont pr\u00e9c\u00e9d\u00e9s. Dans son article sur le chemin tortueux vers la modernisation de l\u2019ONE, Ron Wallace, charg\u00e9 de la r\u00e8glementation chevronn\u00e9 et ancien membre de l\u2019ONE, dresse un survol informatif des d\u00e9veloppements qui ont sans doute contribu\u00e9 au remplacement de l\u2019ONE, tout en faisant ressortir des pr\u00e9occupations sur les r\u00e9percussions du sc\u00e9nario envisag\u00e9 par le projet de loi\u00a0 C-69, non seulement pour les projets de gazoducs, mais aussi pour l\u2019int\u00e9grit\u00e9 globale du syst\u00e8me de r\u00e8glementation.<\/p>\n<p>Le discours public sur le projet de loi C-69 \u00e9tait ax\u00e9, ce qui n\u2019a rien d\u2019\u00e9tonnant, sur l\u2019incidence que ce dernier aura sur les projets de gazoducs r\u00e8glement\u00e9s par le gouvernement f\u00e9d\u00e9ral. Toutefois, le nouveau cadre propos\u00e9 va bien au-del\u00e0 des projets de gazoducs et comprend des projets de production et d\u2019exploration gazi\u00e8re et p\u00e9troli\u00e8re en mer ainsi que d\u2019\u00e9ventuels projets d\u2019\u00e9nergie renouvelable en mer. Daniel Watt en a \u00e9tudi\u00e9 les r\u00e9percussions dans son article portant sur la <em>Loi sur l\u2019\u00e9valuation d\u2019impact<\/em>,\u00a0 la <em>Loi sur la R<\/em>\u00e9gie canadienne de l\u2019\u00e9nergie et l\u2019\u00e9nergie extrac\u00f4ti\u00e8re : vision du Canada atlantique.<\/p>\n<p>Des changements notables dans la r\u00e8glementation environnementale, qui ont des r\u00e9percussions sur les industries \u00e9nerg\u00e9tiques, se poursuivent \u00e9galement \u00e0 l\u2019\u00e9chelle provinciale. Ludovic Fraser examine les faits r\u00e9cents survenus au Qu\u00e9bec dans un article sur le nouveau cadre d\u2019autorisation environnementale.<\/p>\n<p>L\u2019\u00e9laboration de r\u00e8glements et de politiques aux \u00c9tats-Unis a des r\u00e9percussions non n\u00e9gligeables sur l\u2019industrie \u00e9nerg\u00e9tique canadienne. Scott Hempling nous livre un commentaire r\u00e9fl\u00e9chi sur les le\u00e7ons que l\u2019on peut d\u00e9gager de l\u2019univers de la r\u00e8glementation des services publics dans son\u00a0 article sur\u00a0 la r\u00e8glementation efficace des services publics, source d\u2019unit\u00e9 pour une Am\u00e9rique divis\u00e9e.<\/p>\n<p>Entre-temps, les organismes de r\u00e8glementation de l\u2019\u00e9nergie vaquent \u00e0 leurs activit\u00e9s quotidiennes. David Stevens passe en revue le rapport final de la Commission de l\u2019\u00e9nergie de l\u2019Ontario sur les frais de raccordement aux poteaux d\u2019\u00e9lectricit\u00e9.<\/p>\n<p>Enfin, on trouvera \u00e0 la fin de ce num\u00e9ro un examen par A.
