Cependant, il convient d\u2019aborder ces difficult\u00e9s selon trois\u00a0rubriques g\u00e9n\u00e9rales interreli\u00e9es, soit l\u2019acceptation publique (ou \u00ab\u00a0licence sociale\u00a0\u00bb), la consultation des Autochtones et les changements climatiques. Les articles du pr\u00e9sent num\u00e9ro de la <em>Publication trimestrielle sur la r\u00e8glementation de l\u2019\u00e9nergie<\/em> apportent beaucoup au dialogue continu sur chacun de ces domaines.<\/p>\n<p>Le processus d\u2019approbation des grands projets de pipelines, en particulier, est devenu fortement politis\u00e9. Certains ont donc conclu que le syst\u00e8me de r\u00e8glementation est \u00ab\u00a0bris\u00e9\u00a0\u00bb ou, dans le vocabulaire privil\u00e9gi\u00e9 par le gouvernement f\u00e9d\u00e9ral, qu\u2019il doit \u00e0 tout le moins \u00eatre \u00ab\u00a0modernis\u00e9\u00a0\u00bb. Dans ce contexte, il ne pourrait y avoir besoin plus clair que de proc\u00e9der \u00e0 une recherche et une analyse fond\u00e9es sur des donn\u00e9es probantes afin d\u2019\u00e9tayer tout processus de r\u00e9forme. D\u2019ailleurs, le projet \u00c9nergie positive, lanc\u00e9 \u00e0 l\u2019Universit\u00e9 d\u2019Ottawa en 2015, vise \u00e0 renforcer la confiance du public \u00e0 l\u2019\u00e9gard des politiques, de la r\u00e8glementation et du processus d\u00e9cisionnel en mati\u00e8re d\u2019\u00e9nergie au moyen de cette recherche et de cette analyse, d\u2019une mobilisation et de recommandations.<\/p>\n<p>La <em>Publication trimestrielle sur la r\u00e8glementation de l\u2019\u00e9nergie<\/em> pr\u00e9sentera une s\u00e9rie d\u2019articles s\u2019appuyant sur la recherche et l\u2019analyse du projet \u00c9nergie positive. Le premier est publi\u00e9 dans le pr\u00e9sent num\u00e9ro et offre un aper\u00e7u des activit\u00e9s et des r\u00e9sultats des \u00e9tudes men\u00e9es au cours des trois derni\u00e8res ann\u00e9es dans le cadre du projet. L\u2019article r\u00e9dig\u00e9 par Michael\u00a0Cleland et Monica\u00a0Gattinger dans le pr\u00e9sent num\u00e9ro s\u2019intitule <em>Syst\u00e8me en crise : la prise de d\u00e9cisions en mati\u00e8re d\u2019\u00e9nergie au Canada et la r\u00e9forme \u00e9clair\u00e9e n\u00e9cessaire<\/em>. On y cerne bien la situation actuelle du cadre de r\u00e8glementation de l\u2019\u00e9nergie au Canada (le \u00ab\u00a0syst\u00e8me en crise\u00a0\u00bb) et le d\u00e9fi \u00e0 venir (la \u00ab r\u00e9forme \u00e9clair\u00e9e n\u00e9cessaire \u00bb).<\/p>\n<p>Les organismes de r\u00e8glementation de l\u2019\u00e9nergie et les promoteurs de projets sont aux prises avec d\u2019autres difficult\u00e9s d\u00e9coulant des lois qui ne cessent de voir le jour sur la consultation des Autochtones. Les cons\u00e9quences de deux r\u00e9centes d\u00e9cisions importantes de la Cour supr\u00eame du Canada sont abord\u00e9es par Dwight\u00a0Newman dans son article intitul\u00e9 <em>Changement des attentes relatives \u00e0 l\u2019obligation de consulter pour les organismes de r\u00e8glementation du secteur de l\u2019\u00e9nergie : r\u00e9percussions plus larges des d\u00e9cisions de la Cour supr\u00eame du Canada dans premi\u00e8re nation <\/em>Chippewas de la Thames<em> et <\/em>Clyde River<em>.<\/em><\/p>\n<p>Les mesures politiques et r\u00e8glementaires sur les changements climatiques dominent toujours le d\u00e9bat sur l\u2019\u00e9nergie au Canada. Les r\u00e9cents progr\u00e8s en Ontario sont examin\u00e9s par Tyson Dyck, Dennis\u00a0Mahony, Henry\u00a0Ren et Caitlin\u00a0Milne dans l\u2019article intitul\u00e9 <em>Entente de plafonnement et d\u2019\u00e9change de l\u2019Ontario avec le Qu\u00e9bec et la Californie<\/em>. L\u2019entente dont il est question entrera en vigueur le 1<sup>er<\/sup><sup>\u00a0<\/sup>janvier\u00a02018.<\/p>\n<p>Les autres articles du pr\u00e9sent num\u00e9ro de la <em>Publication trimestrielle sur la r\u00e8glementation de l\u2019\u00e9nergie<\/em> abordent une vari\u00e9t\u00e9 de sujets. Dans son article intitul\u00e9 <em>Changements l\u00e9gislatifs et r\u00e8glementaires encadrant les hydrocarbures et les pipelines<\/em>, Ludovic\u00a0Fraser examine les r\u00e9cents progr\u00e8s r\u00e9alis\u00e9s au Qu\u00e9bec.<\/p>\n<p>Dans leur article intitul\u00e9 <em>Aller de l\u2019avant avec la r\u00e9forme des tarifs<\/em>, Ahmad Faruqui et Mariko Geronimo Aydin examinent les quatre \u00ab\u00a0vagues\u00a0\u00bb de r\u00e9forme du tarif de l\u2019\u00e9lectricit\u00e9 qui a, estimentils, \u00e9volu\u00e9 aux \u00c9tats-Unis depuis les ann\u00e9es 1980. Les auteurs laissent entendre que la \u00ab\u00a0prochaine vague de r\u00e9forme du tarif arrivera bient\u00f4t, et elle fournira aux clients de meilleurs outils et de l\u2019information suppl\u00e9mentaire, qui permettront aux clients de contribuer \u00e0 une efficacit\u00e9 accrue de l\u2019alimentation en \u00e9nergie et donneront aux clients un plus grand contr\u00f4le \u00e0 l\u2019\u00e9gard du type et du co\u00fbt de l\u2019\u00e9nergie qu\u2019ils consomment.\u00a0\u00bb<\/p>\n<p>Le pr\u00e9sent num\u00e9ro de la <em>Publication trimestrielle sur la r\u00e8glementation de l\u2019\u00e9nergie<\/em> pr\u00e9sente deux commentaires de cas. Molly Reynolds, Caitlin\u00a0Morin et Amir Eftekharpour commentent la d\u00e9cision r\u00e9cente de la cour d\u2019appel de l\u2019Ontario dans l\u2019affaire <em>Orlandis<\/em>, qui estime qu\u2019un service public communiquant les donn\u00e9es de consommation \u00e9nerg\u00e9tique des r\u00e9sidents avec la police, ce qui a men\u00e9 \u00e0 une fouille et \u00e0 des accusations criminelles, est une violation de l\u2019attente raisonnable au respect de la\u00a0vie priv\u00e9e des r\u00e9sidents. Dans l\u2019article intitul\u00e9 <em>Les organismes de r\u00e8glementation de l\u2019\u00e9nergie et les d\u00e9passements de co\u00fbts : la d\u00e9cision Maritime\u00a0Link de la Nouvelle-\u00c9cosse<\/em>, notre co-r\u00e9dacteur Gordon Kaiser commente la toute derni\u00e8re d\u00e9cision de la Commission des services publics et d\u2019examen de la Nouvelle-\u00c9cosse (NSUARB), d\u00e9coulant du projet en difficult\u00e9 de Muskrat Falls et du projet Maritime Link.<\/p>\n<p>Le pr\u00e9sent num\u00e9ro se termine par un examen par notre co-r\u00e9dacteur Gordon Kaiser de la troisi\u00e8me \u00e9dition de la r\u00e9f\u00e9rence normalis\u00e9e intitul\u00e9e <em>Arbitration Law of Canada: Practice and Procedure<\/em> de J.
