Peu importe la port\u00e9e des changements propos\u00e9s, la l\u00e9gislation \u00e9tablira un nouveau cadre r\u00e8glementaire et elle cherchera \u00e0 relever les d\u00e9fis qui ont \u00e9merg\u00e9 lors de l\u2019examen de grands projets au cours des derni\u00e8res ann\u00e9es, de Northern Gateway au prolongement du pipeline TransMountain en passant par le renversement et le prolongement de la ligne\u00a09 d\u2019Enbridge. Autrement, la r\u00e9ussite du nouveau cadre jouera un r\u00f4le vital pour d\u00e9terminer dans quelle mesure le d\u00e9veloppement des ressources d\u2019hydrocarbures du Canada se poursuivra. Par cons\u00e9quent, la l\u00e9gislation propos\u00e9e doit \u00eatre soigneusement \u00e9tudi\u00e9e par la communaut\u00e9 de r\u00e8glementation de l\u2019\u00e9nergie.<\/p>\n<p>Tout changement propos\u00e9 au r\u00f4le de l\u2019Office national de l\u2019\u00e9nergie (ONE) doit \u00eatre \u00e9tudi\u00e9 de concert avec les changements propos\u00e9s au processus d\u2019\u00e9valuation environnementale f\u00e9d\u00e9ral, comme il est clairement expliqu\u00e9 dans le document de travail d\u00e9pos\u00e9 en juin intitul\u00e9 <em>Examen des processus environnementaux et r\u00e8glementaires.<\/em> Le document de travail \u00e9nonce l\u2019engagement du gouvernement de \u00ab\u00a0mettre en \u0153uvre des processus d\u2019\u00e9valuation environnementale et r\u00e8glementaire qui permettent de r\u00e9tablir la confiance du public, de prot\u00e9ger l\u2019environnement, d\u2019int\u00e9grer des mesures de sauvegarde modernes, de faire avancer la r\u00e9conciliation avec les peuples autochtones, d\u2019assurer la poursuite des bons projets et la mise en march\u00e9 des ressources\u00a0\u00bb.<\/p>\n<p>Ce num\u00e9ro de la <em>Publication trimestrielle sur la r\u00e8glementation de l\u2019\u00e9nergie <\/em>comprend trois articles que nous croyons utiles pour se pr\u00e9parer au d\u00e9bat \u00e0 venir. Dans son article \u00ab\u00a0Rapport du comit\u00e9 d\u2019experts sur la modernisation de l\u2019Office national de l\u2019\u00e9nergie et la r\u00e9ponse du gouvernement du Canada\u00a0\u00bb, Professeur Nigel\u00a0Bankes examine les d\u00e9veloppements \u00e0 ce jour sp\u00e9cialement par rapport \u00e0 leur relation avec l\u2019ONE. Michael\u00a0Fortier apporte sa contribution avec son article \u00ab\u00a0R\u00e9forme f\u00e9d\u00e9rale de l\u2019\u00e9valuation environnementale : la perspective d\u2019un praticien.\u00a0\u00bb Ensemble, ces deux articles fournissent une fondation solide pour \u00e9valuer les m\u00e9rites et l\u2019efficacit\u00e9 possible des changements pr\u00e9cis qui sont propos\u00e9s lorsque la l\u00e9gislation sera finalement d\u00e9pos\u00e9e.<\/p>\n<p>\u00c0 ce jour, la discussion sur les processus d\u2019examen r\u00e8glementaires et environnementaux a largement mis l\u2019accent sur les probl\u00e8mes li\u00e9s au mandat, \u00e0 la structure et \u00e0 la proc\u00e9dure. Un regard insuffisant a \u00e9t\u00e9 port\u00e9 sur le <strong>but<\/strong> de la r\u00e8glementation dans le contexte des projets d\u2019infrastructure \u00e9nerg\u00e9tique. Toutefois, la question n\u2019a pas \u00e9t\u00e9 enti\u00e8rement ignor\u00e9e. Plus t\u00f4t cette ann\u00e9e, l\u2019institut C. D.\u00a0Howe a publi\u00e9 un commentaire intitul\u00e9<em> Defining the Public Interest in Regulatory Decisions<\/em><em>\u00a0: <\/em><em>The Case for Economic Efficiency<\/em>, r\u00e9dig\u00e9 par Jeffrey\u00a0Church, dans lequel l\u2019auteur plaide que \u00ab\u00a0[d]e nombreuses pr\u00e9occupations concernant les d\u00e9cisions r\u00e8glementaires et le processus r\u00e8glementaire pourraient dispara\u00eetre, ou \u00eatre att\u00e9nu\u00e9es, si les gouvernements articulaient clairement dans une loi que les organismes de r\u00e8glementation devraient fonder leurs d\u00e9cisions uniquement sur des bases d\u2019efficacit\u00e9 \u00e9conomique\u00a0\u00bb. Dans \u00ab\u00a0Le mandat de l\u2019Office national de l\u2019\u00e9nergie\u00a0\u00bb, Peter\u00a0Miles, ancien \u00e9conomiste principal de l\u2019ONE, r\u00e9pond \u00e0 la th\u00e8se de M.\u00a0Church, en faisant une r\u00e9f\u00e9rence particuli\u00e8re aux changements propos\u00e9s aux objectifs de la r\u00e8glementation comme il est soulign\u00e9 dans le document de travail du gouvernement <em>Examen des processus environnementaux et r\u00e8glementaires<\/em>.<\/p>\n<p>Pendant ce temps, alors que la r\u00e9forme r\u00e8glementaire de l\u2019\u00e9nergie f\u00e9d\u00e9rale regarde vers l\u2019avenir, les d\u00e9fis de la mise en \u0153uvre du changement, et \u00ab\u00a0faire la bonne chose\u00a0\u00bb, sont illustr\u00e9s par une exp\u00e9rience r\u00e9cente de mise en \u0153uvre de changements de politique en Ontario. Adam\u00a0White examine les d\u00e9veloppements des politiques d\u2019\u00e9lectricit\u00e9 en Ontario dans son article \u00ab\u00a0B\u00eate noire d\u2019un premier ministre\u00a0: une histoire populaire de la politique sur l\u2019\u00e9lectricit\u00e9 en Ontario\u00a0\u00bb.\u00a0 Les d\u00e9fis propres \u00e0 la mise en \u0153uvre du Plan ontarien pour des frais d\u2019\u00e9lectricit\u00e9 \u00e9quitables\u00a0sont abord\u00e9s par David\u00a0Stevens dans son article \u00ab\u00a0Le plan ontarien pour des frais d\u2019\u00e9lectricit\u00e9 \u00e9quitables vient \u00e0 un co\u00fbt (futur)\u00a0\u00bb et par Tom\u00a0Adams dans \u00ab\u00a0La Loi de 2017 sur le Plan ontarien pour des frais d\u2019\u00e9lectricit\u00e9 \u00e9quitables bouleverse les finances et l\u2019administration des tarifs\u00a0\u00bb.<\/p>\n<p>Finalement, dans leur commentaire d\u2019arr\u00eat de ce num\u00e9ro d\u2019<em>ERQ<\/em>, John\u00a0Vellone et Jessica-Ann\u00a0Buchta discutent de la r\u00e9cente d\u00e9cision de la Commission de l\u2019\u00e9nergie de l\u2019Ontario d\u2019approuver une demande contest\u00e9e par ELK Energy Inc. de prolonger sa zone de service sous permis pour fournir des services de distribution d\u2019\u00e9lectricit\u00e9 \u00e0 un seul client.
