Malgr\u00e9 les conclusions r\u00e9p\u00e9t\u00e9es auxquelles en est venu le D\u00e9partement d\u2019\u00c9tat des \u00c9tats-Unis dans ses \u00e9valuations, \u00e0 savoir que le projet n\u2019entra\u00eenerait \u00ab\u2005aucun changement consid\u00e9rable dans la quantit\u00e9 d\u2019\u00e9missions de gaz \u00e0 effet de serre [et] ne risquerait pas d\u2019avoir une incidence importante sur le taux de d\u00e9veloppement dans les sables bitumineux [canadiens]\u2005\u00bb<sup>1<\/sup>, en novembre\u00a02015, le pr\u00e9sident Barack Obama a refus\u00e9 d\u2019octroyer un permis pour le projet, d\u00e9clarant qu\u2019une telle approbation aurait min\u00e9 le r\u00f4le de l\u2019Am\u00e9rique en tant que \u00ab\u2005leader mondial dans la prise de mesures s\u00e9rieuses pour lutter contre les changements climatiques\u2005\u00bb<sup>2<\/sup>. Bien que le projet Keystone\u00a0XL ait depuis \u00e9t\u00e9 autoris\u00e9 par le pr\u00e9sident Donald Trump, il ne faut pas n\u00e9gliger les le\u00e7ons qu\u2019il faut tirer de ce refus pr\u00e9c\u00e9dent pour le Canada, l\u00e0 o\u00f9 d\u2019autres projets d\u2019ol\u00e9oducs sont tout aussi controvers\u00e9s, d\u2019autant plus que le gouvernement f\u00e9d\u00e9ral proc\u00e8de \u00e0 l\u2019examen du rapport du Comit\u00e9 d\u2019experts sur la Modernisation de l\u2019Office national de l\u2019\u00e9nergie<sup>3<\/sup>. Il y a fort \u00e0 parier que ce d\u00e9bat anim\u00e9 se poursuivra.<\/p>\n<p>L\u2019ouvrage de Dennis McConaghy, <em>DYSFUNCTION: Canada after Keystone\u00a0XL <\/em>devrait \u00eatre accueilli par toutes les parties int\u00e9ress\u00e9es en tant que contribution indispensable \u00e0 ce d\u00e9bat<sup>4<\/sup>. Il s\u2019agit d\u2019une chronique unique offrant une \u00ab\u2005perspective de l\u2019int\u00e9rieur\u2005\u00bb. Avant de prendre sa retraite, M.\u00a0McConaghy \u00e9tait cadre sup\u00e9rieur chez TransCanada et il a particip\u00e9 directement \u00e0 la conception et \u00e0 l\u2019ex\u00e9cution du projet Keystone\u00a0XL d\u00e8s le tout d\u00e9but de la cr\u00e9ation du projet au milieu des ann\u00e9es\u00a02000.<\/p>\n<p>Cette contribution incitera sans doute les opposants au projet Keystone\u00a0XL \u00e0 \u00e9carter ses conclusions au motif qu\u2019elles sont int\u00e9ress\u00e9es, mais il s\u2019agirait l\u00e0 d\u2019une erreur monumentale. Une grande partie de la controverse entourant le projet (et, de fait, son rejet par le pr\u00e9sident Obama) concerne la mesure dans laquelle il contribuerait aux \u00e9missions de gaz \u00e0 effet de serre et aurait une incidence sur les changements climatiques. Les changements climatiques sont \u00e9galement au c\u0153ur des principales contestations \u00e0 l\u2019\u00e9gard d\u2019autres projets d\u2019ol\u00e9oducs. Toutefois, M.\u00a0McConaghy ne nie aucunement l\u2019existence des changements climatiques\u00a0:<\/p>\n<p style=\"padding-left: 30px;\">\u00ab\u00a0Soyons clairs; je crois que les \u00e9missions de gaz \u00e0 effet de serre d\u00e9coulant de l\u2019activit\u00e9 humaine augmentent le risque de changements climatiques. C\u2019est un risque que nous devons g\u00e9rer<sup>5<\/sup>.\u00a0\u00bb<\/p>\n<p>En effet, il soutient pr\u00e9cis\u00e9ment la taxe sur le carbone et fait valoir que le destin du projet Keystone\u00a0XL aux mains d\u2019Obama pourrait tr\u00e8s bien avoir \u00e9t\u00e9 diff\u00e9rent si le gouvernement du premier ministre Stephen Harper ne s\u2019\u00e9tait pas si ardemment oppos\u00e9 \u00e0 une telle taxe.<\/p>\n<p>Donc, il est justifi\u00e9 d\u2019accorder \u00e0 la conclusion de M.\u00a0McConaghy toute la consid\u00e9ration qui lui est due. L\u2019annulation du projet Keystone\u00a0XL \u00ab\u2005n\u2019\u00e9tait qu\u2019un acte symbolique, sans v\u00e9ritable cons\u00e9quence sur la gestion s\u00e9rieuse des risques de changements climatiques\u2005\u00bb.<\/p>\n<p>La frustration de M.\u00a0McConaghy est palpable dans son observation du fait que le refus ultime du projet par le pr\u00e9sident Obama (lorsqu\u2019il a finalement pris une d\u00e9cision) signifiait \u00ab\u2005la fin d\u2019un simulacre fourbe et insoutenable\u2005\u00bb. Il ne s\u2019agit pas l\u00e0 que d\u2019une simple hyperbole \u2013 tout au long du processus, M.\u00a0McConaghy note des cas o\u00f9 TransCanada a \u00e9t\u00e9 amen\u00e9e \u00e0 croire que son acceptation de conditions suppl\u00e9mentaires et d\u2019\u00e9valuations environnementales m\u00e8nerait ultimement \u00e0 une approbation. En r\u00e9trospective, il est devenu \u00e9vident que l\u2019administration am\u00e9ricaine avait l\u2019intention de retarder la prise d\u2019une d\u00e9cision finale plut\u00f4t que de pr\u00e9server l\u2019int\u00e9grit\u00e9 du processus r\u00e8glementaire. Au moment du refus d\u00e9finitif du projet en novembre\u00a02015, le secr\u00e9taire d\u2019\u00c9tat John Kerry a d\u00e9clar\u00e9 que la d\u00e9cision \u00ab\u2005ne pouvait pas \u00eatre prise simplement en fonction des chiffres\u2005\u00bb<sup>6<\/sup>. Selon M.\u00a0McConaghy, il s\u2019agissait sans doute d\u2019un \u00ab\u2005reflet fid\u00e8le\u2005\u00bb de l\u2019\u00e9tat d\u2019esprit du pr\u00e9sident et du secr\u00e9taire d\u2019\u00c9tat, l\u2019amenant \u00e0 conclure que \u00ab\u2005l\u2019application r\u00e9guli\u00e8re de la loi et les \u00e9valuations technocratiques n\u2019y \u00e9taient pour rien\u2005\u00bb.<\/p>\n<p>Il existe des diff\u00e9rences \u00e9videntes entre les processus d\u2019examen r\u00e8glementaire aux \u00c9tats-Unis et au Canada. Le constat que fait M.\u00a0McConaghy au sujet de l\u2019exp\u00e9rience Keystone\u00a0XL demeure n\u00e9anmoins pertinent ici, alors que la politisation des projets d\u2019\u00e9nergie continue de cro\u00eetre. En 2012, le r\u00f4le de l\u2019Office national de l\u2019\u00e9nergie a connu un changement fondamental alors qu\u2019il est pass\u00e9 de d\u00e9cideur \u00e0 conseiller, la prise de d\u00e9cisions directes ayant \u00e9t\u00e9 transf\u00e9r\u00e9e au cabinet f\u00e9d\u00e9ral. La possibilit\u00e9 que la politique l\u2019emporte sur l\u2019analyse ind\u00e9pendante s\u2019est donc consid\u00e9rablement accrue. L\u2019exp\u00e9rience v\u00e9cue dans le cadre du projet Keystone\u00a0XL illustre tr\u00e8s bien les cons\u00e9quences d\u2019emprunter cette voie.<\/p>\n<p>L\u2019\u00e9valuation de M.\u00a0McConaghy n\u2019est pas encourageante\u00a0:<\/p>\n<p style=\"padding-left: 30px;\">\u00ab\u00a0L\u2019id\u00e9e la plus d\u00e9solante qui me fascine au lendemain de la longue d\u00e9route du projet Keystone\u00a0XL, c\u2019est que le Canada n\u2019a pas beaucoup appris&#8230; Les promoteurs de grandes infrastructures d\u2019hydrocarbures dans ce pays doivent suivre un long processus de d\u00e9cision potentiellement malhonn\u00eate, dont les r\u00e9sultats ne sont pas n\u00e9cessairement li\u00e9s au v\u00e9ritable examen r\u00e8glementaire des avantages et des risques environnementaux att\u00e9nu\u00e9s<sup>7<\/sup>.\u00a0\u00bb<\/p>\n<p>Esp\u00e9rons que le d\u00e9bat et les mesures suivant le rapport du Comit\u00e9 d\u2019experts sur la Modernisation de l\u2019Office national de l\u2019\u00e9nergie apporteront des am\u00e9liorations.<\/p>\n<p>Mais, peut-\u00eatre que l\u2019importance plus g\u00e9n\u00e9rale de l\u2019ouvrage <em>Dysfunction<\/em> repose dans son sous-titre\u00a0: <em>Canada after Keystone\u00a0XL<\/em> ou \u00ab\u2005le Canada apr\u00e8s Keystone\u00a0XL\u2005\u00bb. Dans la deuxi\u00e8me partie, M.\u00a0McConaghy examine \u00ab\u2005les autres pipelines du Canada\u00a0: Northern Gateway, TransMountain et \u00c9nergie Est\u2005\u00bb en regard du contexte de l\u2019exp\u00e9rience Keystone\u00a0XL. Son examen l\u2019a men\u00e9 \u00e0 poser la question suivante\u00a0:<\/p>\n<p style=\"padding-left: 30px;\">\u00ab\u00a0Le Canada a-t-il r\u00e9ellement la conviction fondamentale qu\u2019il est dans l\u2019int\u00e9r\u00eat public de d\u00e9velopper ses ressources en hydrocarbures? Depuis l\u2019\u00e9chec du projet KXL, le Canada s\u2019est montr\u00e9 profond\u00e9ment \u00e9quivoque \u00e0 l\u2019\u00e9gard de cette position<sup>8<\/sup>.\u00a0\u00bb<\/p>\n<p>En effet, il s\u2019agit de la question qui est indispensable au d\u00e9bat controvers\u00e9 entourant ces projets d\u2019infrastructure \u00e9nerg\u00e9tiques et ceux \u00e0 venir au Canada.<\/p>\n<p><em>Dysfunction<\/em> s\u2019av\u00e8re une contribution importante au d\u00e9bat. Il doit \u00eatre lu par l\u2019ensemble des politiciens, des d\u00e9cideurs, des organismes de r\u00e8glementation, des membres de l\u2019industrie et des citoyens touch\u00e9s.<\/p>\n<p class=\"footnote\" style=\"margin-left: 14px;\">* Rowland J.
